The state of Florida does not have rent control. Landlords are free to increase a tenant's rent at the time of renewal so long as there is no contract in place binding the parties to a specific rent amount or increase basis.
Generally, no. Florida prohibits self-help evictions and engaging in this conduct can result in serious consequences. If the Tenant consents to assistance with moving out, the Landlord may remove their property peaceably.
The legal process will take at least 21 days, more commonly several weeks. There are timeframes under Florida law for every action that is a part of the process. However, if a tenant voluntarily vacates the property on their own or as part of a settlement agreement, time can be saved for all parties.
It will cost approximately $200.00-$350.00 to file an eviction lawsuit in county court, $10.00 per summons, $50.00-$150.00 for a process server per person to be served. In addition to these unavoidable costs, attorneys fees will apply if counsel is hired. Some attorneys perform evictions at a flat rate (this firm is one) and others only at hourly rates.
A Tenant that is in violation of terms and conditions of the Lease Agreement should be issued a proper statutory notice to cure their actions or behavior. For egregious behavior such as damage to the property, or as otherwise stated in the Lease Agreement, a termination of tenancy may be issued.
