WILL AND TRUST DISPUTES

Unfortunately, our loved ones do not always leave behind clear instructions for the handling of assets after their passing or a bad actor intervenes in an otherwise good plan.


Florida Law allows for will and trust disputes where this and other circumstances occur. What the heirs must do is act quickly to preserve and protect their interests.


Will and Trust Disputes may arise where:

  • A bad actor placed the decedent under duress or exerted undue influence to create a will or trust favorable to them
  • The decedent lacked capacity to create the will or trust
  • A personal representative or beneficiary has presented an invalid will or trust for administration
